PUBLIC NOTICE

NOTICE IS GIVEN that the Board of Supervisors of Willistown Township will hold a public hearing and special meeting to consider passage of the following ordinance at 7:00 PM, September 1, 2022, at the Township Municipal Building located at 688 Sugartown Road, Malvern, PA 19335. Following the public hearing, the Board will consider enactment of the proposed ordinance at a special meeting of the Board of Supervisors. A full text copy of the ordinance is available for public examination without charge or may be obtained for a charge not greater than the cost thereof at the Municipal Building. For further information, please contact Robert Smiley, Zoning Officer (610-647-5300). The preamble and a brief summary prepared by the solicitor listing the provisions in reasonable detail follows:

AN ORDINANCE AMENDING THE ZONING ORDINANCE OF WILLISTOWN TOWNSHIP TO ALIGN THE DEFINITIONS AND REGULATIONS FOR AGRICULTURAL USES WITH APPLICABLE PENNSYLVANIA LAW.

Section 1. Revises the definition of “Agriculture” in § 139-6 of the Zoning Ordinance.

Section 2. Adds a definition for “Agricultural Commodity” in § 139-6 of the Zoning Ordinance.

Section 3. Revises § 139-12.D to change “farm use” to “Agriculture” as a use by right in the RU zoning district.

Section 4. Revises § 139-12.G (without amendment to its constituent paragraphs) to clarify which uses are permitted as accessory uses to a principal use in the RU zoning district.

Section 5. Revises § 139-12.G(4) to delete the reference to the “sale of farm or other products” as an accessory use in the RU zoning district and to permit and regulate direct commercial sales of agricultural commodities, subject to certain stated criteria.

Section 6. Provides for a severability provision.

Section 7. Effective five (5) days from the date of enactment.

Section 8. Provides for a repealer provision.
