Legal NOTICE -East Whiteland Township Public Hearing 11/9/22 7PM

NOTICE IS HEREBY GIVEN that on November  9, 2022 at 7:00 P.M. at the East Whiteland Township Municipal Building located at 209 Conestoga Road, Frazer, PA, the Board of Supervisors of East Whiteland Township shall hold a public meeting at which it will consider the enactment of the following:  an ordinance REPLACING CHAPTER 170 “STORMWATER MANAGEMENT” OF the CODE OF THE TOWNSHIP OF  East whiteland.  The new Stormwater Ordinance updates and amends the current Stormwater Management Ordinance in order to conform its provisions to the County-wide Act 167 Stormwater Management Plan for Chester County, PA and the 2022 County-wide Act 167 Stormwater Management Model Ordinance.  There are 3 options set forth in Section 706 for inspection and maintenance of the SWM BMPs, facilities and/or structures installed under the Ordinance:  (i) Township inspection and a fund established to help cover the costs of inspections and maintenance expenses and setting forth requirements if BMP is to be privately owned or owned and maintained by the Township; or (ii) inspection and BMP Operation and maintenance requirements by the Landowner or Landowner’s Designee; or (iii) a Mixed Approach involving both the Township and Landowner or Landowner’s designee and with a fund.  The Board of Supervisors shall determine at the public meeting which option set forth shall be adopted. The Ordinance includes the following provisions:  repealer, revisions, severability, effective date failure to enforce not a waiver. All ordinances and provisions of the Township which are inconsistent with the proposed new stormwater management ordinance are repealed by the new stormwater management ordinance, and the same is proposed to become effective five (5) days after the date of its enactment.  

Copies of the proposed ordinance are available to the public electronically on the Township’s website or upon request and may be examined without charge.
